This Privacy Policy (“Policy”) is posted to explain to you our online information practices. To make this Policy easy to find, we make it readily available on The Cheeses of Europe Website. Our Policy was last updated and posted on June 29, 2018. It governs the privacy terms of the Site, located at https://cheesesofeurope.com, sub-domains, and any associated web-based and mobile applications (collectively, “Site”), as owned and operated by The Cheeses of Europe. Any capitalized terms not defined in our Policy have the meaning specified in our Terms and Conditions (“Terms”). 

Your privacy is important to us and we have developed this Policy to help you understand how we collect, use, communicate, disclose, and make use of personal information. By using the Site, you agree to the collection and use of information in accordance with this Policy. 

Before or at the time of collecting personal information, we will let you know the purposes for which the information is being collected. We will only collect and use personal information for the reasons disclosed. We will never use your personal information for any other purpose without your consent and will only retain personal information for as long as necessary to fulfill the purposes specified by us.

DEFINITIONS
Content” means all information and other materials present on the Site, including The Cheeses of Europe’s products and services, text, images, photos, advice, ratings, reviews, or similar information.

The Cheeses of Europe is committed to protecting the privacy and security of visitors to its Site. We do not disclose to third parties any of the information provided by you without your permission. Only select staff and contracted individuals have access to personally identifiable information provided by visitors to the Site. To prevent unauthorized access or disclosure, to maintain data accuracy, and to ensure the appropriate use of the information, The Cheeses of Europe utilizes generally accepted industry standards to protect your Personal Data. Please note, however, that security breaches can occur even if reasonable steps are taken to prevent such breaches and that no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your Personal Data. Please contact us if you believe there has been any breach of the security of our Site.

PURPOSES FOR WHICH WE COLLECT PERSONAL DATA
We do not sell your Personal Data to third parties to use for their own marketing purposes. The Cheeses of Europe uses the information we collect for the following purposes:

  • Provide Our Services. To provide the services we offer on our Site, to communicate with you about your use of our Site, to respond to your inquiries, and for other customer services designed to make your experience better.

We use the information you provide to offer, manage, and/or improve our Site or services, including but not limited to:

  • Aggregating certain types of information to better understand or provide better engagement with our users

Your information may be transferred to and maintained on computers and servers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. 

HOW WE PROTECT AND STORE PERSONAL DATA
We store and process your personal information using servers located in the United States. This information is protected by physical, electronic, and procedural safeguards in compliance with applicable United States federal and state regulations. We use Google Firebase to store user data obtained from our mobile application and this information is stored in the United States. The user data we obtain from the Site is stored on a server located in the United States as well. 

We strive to ensure security on our systems. Despite our efforts, we cannot guarantee that personal information may not be accessed, disclosed, altered or destroyed by breach of our administrative, managerial, and technical safeguards. 

If we learn of a systems security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Site or subscribing to our newsletter, you agree that The Cheeses of Europe may communicate with you electronically. The Cheeses of Europe may post a notice on the Site or mobile application if a security breach occurs. We may also send an email to you at the email address you have provided us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. EUROPEAN UNION GENERAL DATA PROTECTION REGULATION 2016/679
European Union General Data Protection Regulation EU 2016/79 (“GDPR”), approved by the European Parliament on April 14, 2106, and effective May 25, 2018, addresses the protection of natural persons located in the EU with respect to the processing of their Personal Data.

GDPR recognizes that Personal Data shall be:

  • Processed lawfully, fairly, and in a transparent manner;
  • Collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  • Adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed;
  • Accurate and, where necessary, kept up to date;
  • Kept in a form that permits identification of Users for no longer than is necessary for the purposes for which the Personal Data is processed; and
  • Processed in a manner that ensures appropriate security of the Personal Data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

As a Controller, The Cheeses of Europe shall be responsible for, and shall be able to demonstrate compliance with, the foregoing principles. Therefore, you have the right:

  • To request the correction or update of any Personal Data that is incorrect or incomplete;
  • To request the erasure of your Personal Data (the right to be forgotten);
  • To portability of your Personal Data;
  • To object to the processing of your Personal Data;
  • Not to be subject to a decision based on automated decision-making, including profiling;
  • To withdraw consent to the processing of your Personal Data; and
  • To register a complaint with a supervisory authority (if you are located in the EU).

Unless otherwise prohibited by law, The Cheeses of Europe will effect any such request without delay. Where The Cheeses of Europe is able to comply with a request for erasure by anonymizing the Personal Data, we will do so.

Under the GDPR, you have the right to be forgotten. If you reside in an EU territory, you may request the deletion of your personal data that we collect, store, or process. When you make your request, we will balance your privacy rights with the interest of the general public in having access to the information, as well as the right of others to distribute the information. For instance, we may refuse to delete information regarding unlawful activities. In the event The Cheeses of Europe receives a request for erasure, or a request to be forgotten, The Cheeses of Europe has the obligation to erase the Personal Data without undue delay (and no longer than 30 days after the request is received), where one of the following grounds applies:

  • The Personal Data is no longer necessary for the purpose for which it was originally collected or processed;
  • You withdraw your consent to the collection processing of your Personal Data;
  • You object to the processing and there is no overriding legitimate interest for continued collection or processing of your Personal Data;
  • You believe your Personal Data was unlawfully processed or collected (i.e., in breach of GDPR);
  • Your Personal Data must be erased in order to comply with an EU or an EU Member State law to which we are subject; or
  • Such Personal Data was processed in relation to the offer of information society services to a child.

We offer you the opportunity to sign up for special events and offers on our Site. You may subscribe to receive periodic e-mails about The Cheeses of Europe. In order to subscribe, we ask that you provide your e-mail address. The Cheeses of Europe will not sell or otherwise share this information. All e-mails will contain an opt-out option whereby the recipient can choose to opt out of receiving all such future e-mails.

CONTACT US INFORMATION
We use the information obtained when you contact us to process and respond to your comments or inquiries. The Cheeses of Europe will not sell or otherwise share your contact information with third parties, but does reserve the right, consistent with the Terms, to reproduce, use, disclose, and distribute the content of your comments or inquiries, and our response, without limitation or compensation.

COOKIES, INTERNET PROTOCOL ADDRESS, AND AGGREGATE INFORMATION
Like many websites, we gather non-personally identifying information about how visitors use our Site or mobile application in order to track usage patterns and other demographics of visitors as a group. The Cheeses of Europe and their affiliates may also use Cookies. These Cookies expire when a user closes the browser in which The Cheeses of Europe Site was viewed. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our Site correctly or at all. The Cheeses of Europe servers also create log files of IP addresses for systems administration and troubleshooting. IP addresses are ID numbers for the location of your computer or network on the Internet. Log files are recordings of the traffic to and from a server. We also track page hits in the aggregate in order to track the popularity of pages that people visit. 

We use this information to improve the design and content of our Site and to help us improve your overall Internet experience. For example, we may use this data to tailor your experience at our Site, showing you content that we think you might be interested in and displaying content according to your preferences. We also may use this information to analyze site usage. We do not share this information with third parties and we never place Personal Data in Cookies.

OTHER INFORMATION SUBMITTED
Blog/Comment Entries. Please be aware that any information you disclose on a publicly accessible area of the Site will be publicly viewable. Please contact us if you believe a Site User is improperly collecting or using information about you or other Site Users.

THIRD PARTY WEBSITES
We may from time to time contract with advertisers or other third parties who place information, advertisements, or other promotional material or links on our Site. Further, our Site will display links to affiliated organizations or other sites that we believe you may find of interest. If you click on an advertisement or other link provided by or to a third party or affiliate and leave our Site, whether through a link or through visiting another website framed within our Site, you are subject to the privacy policies of the advertisers or other third parties or affiliates. We do not have responsibility for or access to the information collected by the advertisers or other third parties or affiliates.

SENSITIVE DATA
We do not intentionally collect, process, transfer, or store Sensitive Data.

INFORMATION FROM CHILDREN
We do not knowingly solicit or collect information from any individuals under the age of 18.

COMPLIANCE WITH LAW OR LEGAL ORDER
The Cheeses of Europe retains the right to disclose Personal Data as allowed or required by law. We may also disclose Personal Data under the following circumstances:

  • To respond to duly authorized information requests of police and government authorities
  • To comply with any law, regulation, subpoena, or court order
  • To investigate and help prevent security threats, fraud, or other malicious activity
  • To investigate and help prevent a violation of any contractual or other relationship with The Cheeses of Europe or the perpetration of any illegal or harmful activity
  • To enforce and protect the rights of The Cheeses of Europe, its affiliates, and its business partners
  • To protect the personal safety of our employees, agents, affiliates, business partners, customers, or Site Users.

In the event of a merger, consolidation, sale, or transfer of all or substantially all of the assets of The Cheeses of Europe, Personal Data stored in our database will be transferred to the purchasing or new entity. However, the use of this information by any purchasing or surviving entity would be governed by the terms of this Policy, as amended from time to time, including any amendment after such transaction.

CHANGES TO OUR PRIVACY POLICY
We may make changes this Policy from time to time, and may need to revise the Policy as the Site is developed and/or new features are added to it. Any changes to our Policy will be effective and applicable upon change of our Policy as accessible through the Site.

We assume that all Users have read this document and agree to its content. If you do not agree with this Policy, you should refrain from using our Site.
